SC bars IHC from further proceedings in audio leaks case

The Supreme Court of Pakistan has stopped the Islamabad High Court from proceeding in the audio leaks case and issued notices to Bushra Bibi and Mian Najam ul Saqib.

According to the details, a two-member bench headed by Justice Aminuddin Khan heard the audio leaks case in the Supreme Court.

Justice Aminuddin Khan inquired whether the high court has determined who is recording the audio? The Additional Attorney General said that this has not been determined yet and the investigation is underway.

To which, Justice Naeem Akhtar Afghan said that unfortunately no one wants to reach the truth in this country. An inquiry commission was formed to find out the truth and it was stayed by the Supreme Court and the audio leaks case has not been fixed in the Supreme Court till date.

Justice Naeem Akhtar Afghan said that when the parliament tried to know the truth, it was also stopped.

Justice Aminuddin Khan said that it is also possibility that the audio was leaked by those who were being talked. Nowadays, every mobile has a recording system.

According to the passed order, the Additional Attorney General said that the judicial proceedings of the Islamabad High Court have not been finalized and the high court exceeded the jurisdiction of Article 199. The principle is fixed in two judicial decisions of the Supreme Court and the high court cannot take notice of itself.

The court was told that the five questions decided in the hearing of the high court on May 31 were not the case of the petitioners. The court was told that the high court cannot investigate.

The Supreme Court barred the Islamabad High Court from proceeding in the audio leaks case and accepted the federal government’s appeals for hearing.

The court suspended the orders of the Islamabad High Court on May 29 and June 25 and issued notices to Bushra Bibi and Najam ul Saqib.
