‘Ordinance is parliament’s contempt in presence of law’

Chief Justice Qazi Faiz Isa has asked the Election Commission of Pakistan that what was the hurry to issue the ordinance?, adding when parliament has made a law then an ordinance is contempt of the lower house.

Hearing the election tribunals case today, the Chief Justice remarked that he failed to understand why the Election Commission did not talk to the chief justice of Lahore High Court. It is not written anywhere in the Constitution that one cannot meet a judge as both are constitutional institutions.

Justice Isa while talking to the ECP counsel said why the commission becomes controversial? You guys failed to hold elections.

The Chief Justice of the Supreme Court said how is the Election Commission making the Presidential Ordinance? This would be an insult to the parliament.

He asked to the ECP lawyer that you were saying that it is your responsibility to conduct elections and the high court should stay away. How can you say that the presidential ordinance could have been brought? Is it legal?

Sikander Bashir, the ECP counsel, replied that he neither made the law nor defending the ordinance.

The Chief Justice remarked that the cases in the Supreme Court are his responsibility, adding do not use your weakness as a reason.
