Who Is Joseph Edlow? USCIS Director Who Wants To End OPT for Foreign Students in the U.S.

Joseph Edlow has officially been confirmed by the U.S. Senate as the new Director of the U.S. Citizenship and Immigration Services (USCIS). His appointment is creating waves, especially among international students, due to his tough stance on the Optional Practical Training (OPT) program.

Who is Joseph Edlow?

Joseph Edlow is a lawyer and long-time government official with a history of working on strict immigration policies. He has served in various roles under both USCIS and the Department of Homeland Security (DHS).

He has also worked as a Deputy Assistant Attorney General in the Office of Legal Policy at the Department of Justice, and as counsel to the House Judiciary Committee’s Subcommittee on Immigration and Border Security. Earlier, Edlow worked as an Assistant Chief Counsel at ICE in Baltimore, handling deportation cases, gang-related immigration, and national security issues.

He holds a Bachelor’s degree from Brandeis University and a Juris Doctor (law degree) from Case Western Reserve University.

Edlow’s Views on the OPT Program

Edlow has been vocal about his disapproval of the OPT and STEM OPT programs, which allow international students to work in the U.S. after completing their studies. During his confirmation hearing, Edlow said: “The law does not clearly authorize OPT employment for F-1 students after graduation. It should be reviewed and possibly removed.”

He added that the Department of Homeland Security (DHS) had misapplied the law for years by allowing such work permits.

He also criticized Curricular Practical Training (CPT), calling it “statutorily suspect” and hinted at a crackdown on both CPT and OPT authorizations.

What Does This Mean for International Students?

Edlow’s appointment is raising alarms among universities, student organizations, and tech companies that rely on international talent. The OPT program allows international students, especially in STEM fields, to gain up to 36 months of work experience in the U.S. after graduation.

If USCIS moves to eliminate or reduce the OPT program under Edlow’s leadership, thousands of international students and employers could be affected.

Political Backlash and Support

Democrats, including Senate Judiciary Committee Ranking Member Dick Durbin, have opposed Edlow’s appointment. Durbin accused him of planning to turn USCIS into a tool for mass deportation, even of law-abiding immigrants.

On the other hand, conservative think tanks like the Heritage Foundation, where Edlow was a Visiting Fellow, support his approach.

What Happens Next?

As Edlow takes over USCIS, policy changes may begin slowly but could become more aggressive closer to the 2026 election cycle. Analysts suggest that work visa programs, student visas, and employment-based immigration will be closely reviewed under his leadership.
