SC Overturns Order Halting Justice Jahangiri from Work

The Supreme Court of Pakistan has nullified the interim order of the Islamabad High Court that had stopped Justice Tariq Mehmood Jahangiri from performing his judicial duties.

The Supreme Court’s constitutional bench accepted the appeal filed by Justice Jahangiri, declaring that a judge cannot be barred from work through an interim court order.

During the hearing, the Attorney General stated that under the law, a judge cannot be suspended from judicial work through temporary or interim orders. The apex court agreed with this argument, noting that based on submissions from all parties, such a suspension was not legally justified.

The court also observed that the petition filed in the Islamabad High Court had procedural objections and the petitioner did not adequately defend the order stopping the judge from work.

This decision reinstates Justice Tariq Jahangiri to his judicial duties and sets a precedent regarding the limits of interim court powers over sitting judges.
