Election Act amendment cannot undo July 12 ruling on reserved seats: SC

18 October, 2024 18:39

The Supreme Court (SC) has reiterated that amendments to the Election Act cannot nullify its July 12 ruling on reserved seats.

A majority of eight judges of the top court issued the clarification on Friday.

The judges clarified that Election Act Amendments cannot override judicial decisions, including the July 12 ruling of the top court.

The Supreme Court initially ruled on July 12 that the Pakistan Tehreek-e-Insaf (PTI) was eligible for reserved seats, contradicting the Election Commission’s March 1 decision.

The development comes hours after the Election Commission of Pakistan (ECP) legal team had advised to restore the lawmakers who were suspended after the SC July 12 order.

SC verdict

A 13-member bench of the top court, headed by Chief Justice Qazi Faez Isa, ruled that the PTI is eligible for the allocation of reserved seats.

Justice Mansoor Ali Shah announced the 8-5 majority verdict, setting aside the Peshawar High Court’s (PHC) order
