Supreme Court Dismisses Challenges to Bench Legitimacy in Reserved Seats Case, Allows Live Streaming

22 May, 2025 17:49

In a key ruling on Thursday, the Supreme Court of Pakistan dismissed multiple petitions questioning the legitimacy of the Constitution Bench formed to hear the high-profile case regarding reserved seats claimed by the Sunni Ittehad Council (SIC).

The court declared the bench’s formation lawful and valid, rejecting all objections raised against its constitution. This paves the way for uninterrupted proceedings on a case that could shape the legal landscape for political representation and post-election realignments.

Live Streaming Permitted for Public Transparency

In a landmark move, the apex court permitted live streaming of the proceedings, citing the constitutional significance and public interest surrounding the case.

“Transparency in judicial proceedings is vital in matters of national importance,” the bench noted, instructing the IT Department of the Supreme Court to ensure technical arrangements are made for continued live coverage of future hearings.

This step marks a major shift toward open access to legal deliberations and aligns with global trends of judicial transparency.

Short Order Issued, Detailed Judgment to Follow

The court issued a brief order, with a detailed written judgment to be released later. The order addressed the legal objections raised by SIC, which is seeking allocation of reserved seats for women and minorities—a contentious issue following the party’s political realignment after the 2024 general elections.

No Delay Due to 26th Amendment Case

The court also denied a request to delay hearings until the verdict in the 26th Constitutional Amendment case is announced. The bench emphasized that both matters are separate and can proceed independently.

“The reserved seats case concerns specific post-election developments, while the 26th Amendment addresses broader constitutional changes,” the judges observed.

Legal and Political Significance

The ongoing case is being closely watched as it raises complex questions around:

  • Post-election alliances and seat entitlement

  • Eligibility of parties for reserved seats under current law

  • Parliamentary procedure vs. constitutional interpretation

Observers note that the court’s final verdict could set a precedent for future electoral cycles, affecting party strategies and coalition dynamics in the National and Provincial Assemblies.

Next Hearing on Monday

The court adjourned the proceedings until Monday, with live streaming to continue. As the case unfolds, legal experts and political stakeholders await a decision that may redefine parliamentary representation frameworks in Pakistan.
