Gandapur’s handwritten resignation received at KP Governor House

A handwritten resignation letter from Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur has been received at the Governor’s House, officials confirmed on Saturday.

According to Governor Faisal Karim Kundi, the resignation — signed personally by Gandapur — was officially received around 2:30 pm. A spokesperson from the Governor’s House also confirmed that the letter would be processed according to constitutional and legal procedures before taking effect.

“We will take the matter forward in a transparent and orderly manner, keeping in mind all constitutional and legal requirements,” the spokesperson said.

Governor Kundi says process will follow Constitution

Governor Kundi said the matter would move forward under the Constitution and relevant laws. “The resignation is being examined in accordance with the Constitution and applicable legal provisions, and will be implemented once all formalities are completed,” he stated.

Officials added that the Governor House is currently reviewing the document to ensure all steps are complete before notifying the provincial assembly and other authorities.

No-confidence motion declared unworkable

Meanwhile, legal experts and the Khyber Pakhtunkhwa Assembly Secretariat discussed the option of a no-confidence motion against Gandapur. However, sources said the motion was declared unworkable after the resignation was submitted.

According to KP Advocate General Shah Faisal, Article 130(8) of the Constitution clearly explains the procedure for a chief minister’s resignation. “The Constitution states that the resignation must be sent to the governor, but it does not require the governor’s formal approval,” he said.

AG clarifies constitutional procedure

The Advocate General further explained that a chief minister’s resignation does not need approval since it falls under a unilateral constitutional position.

“Approval is mandatory in bilateral resignations, but not in unilateral ones like that of a chief minister,” he added, citing court precedents that support this interpretation.

He also noted that all constitutional offices, including the chief minister’s, operate under the unilateral resignation principle, meaning submitting the resignation alone is enough to start the process.
