FCC Denies Islamabad HC Judges’ Appeal Over Transfer Ruling
ISLAMABAD: The Federal Constitution Court (FCC) denied a request made by five judges of the Islamabad High Court (IHC) to return the judges’ transfer ruling to the Supreme Court (SC) through an intra-court appeal (ICA) on Monday.
The ruling was based on a miscellaneous petition that the IHC’s Justices Mohsin Akhtar Kiyani, Tariq Mehmood Jahangiri, Babar Sattar Ejaz Ishaq Khan, and Saman Riffaty Imtiaz filed in the FCC, claiming that the Supreme Court should consider the case.
However, the FCC’s larger six-member bench heard the case, headed by Chief Justice Aminuddin Khan and including Justice Syed Hassan Azhar Rizvi, Justice KK Agha, Justice Aamer Farooq, Justice Ali Baqir Najafi, Justice Rozi Khan Barrech, and Justice Arshad Hussain Shah.
The bench during the hearing refused the judges’ plea on account of non-compliance, following the fact that none of the judges appeared before the court.
