Assam Court Grants Bail Only if ‘Jai Hind’ Chanted; Judiciary Serves Modi’s Hindutva Agenda

In a controversial move, an Assam court granted bail to a Muslim citizen on the condition that he chant the slogan ‘Jai Hind’ three times daily and upload the video on social media. This order shows the increasing ideological bias and state oppression faced by Muslims under the Modi government.
According to the Indian news outlet The Wire, the court instructed Arifur Rahman to record the slogan ‘Jai Hind’ and share it publicly. This condition directly contradicts the legal principle that bail does not determine a person’s guilt or innocence.
The Wire highlighted that the court’s order attempts to enforce ideological loyalty through legal coercion. The real purpose of bail, it emphasized, is to keep the accused free until the trial concludes, not to impose any form of punishment.
Forcing an accused—who has not been declared guilty—to prove loyalty by chanting ‘Jai Hind’ runs counter to fundamental justice principles and the concept of ‘benefit of the doubt,’ The Wire stated.
The Modi regime, the judiciary, media, and law have increasingly become tools of fascist politics, suppressing justice, truth, and constitutional rights. This judicial behavior severely threatens the impartiality of courts and undermines the very foundations of justice.
The Wire further noted that such conditions are not unprecedented; courts have previously imposed controversial bail conditions, such as requiring donations to the PM CARES fund or installation of televisions in hospitals, thereby mocking the justice system.
The Assam court’s ruling sets a dangerous precedent by turning the judiciary into an instrument of the Modi government’s political agenda. These decisions blatantly violate the purpose of bail and constitutional freedoms.
This misuse of judicial authority is reinforcing discriminatory attitudes targeting minorities, particularly Muslims, who continue to face injustice and denial of fundamental rights under the current regime.
