Custody Battle Sparks Between Elon Musk and Ashley St

13 January, 2026 15:53

Elon Musk has responded to Ashley St clair following her recent remarks about the transgender community. The billionaire is now reportedly threatening a custody dispute over their son, born in 2024.

“I will be filing for full custody today, given her statements implying she might transition a one-year-old boy,” Musk, 54, proclaimed in a post on X on Monday, January 12, referring to Romulus, the 16-month-old son he shares with St. Clair, 27.

Ashley St. Clair has expressed feeling “immense guilt” for her “part” in causing harm to the transgender community.

Musk’s legal threat followed St. Clair, who has moved away from her conservative views, revealing that she has significantly softened her position on gender transitions—an issue the Tesla CEO strongly opposes.

“Twitter was better when it was woke tbh,” the former MAGA queen wrote in an Instagram exchange, adding, “Dark woke cause the other option is bootlicking feds + pedophiles + nerds?”

One user asked St. Clair, “You’ve previously engaged in blatant transphobia. How do you feel about trans people in the wake of noticing how the far right truly is?”

“I feel immense guilt for my role. And even more guilt that things I have said in the past may have caused my son’s sister more pain,” she responded, referencing Musk’s transgender daughter, Vivian Wilson, 21, who came out as a woman in 2020.

Musk and Vivian, his daughter with ex-wife Justine Wilson, are reportedly deeply estranged. He has described her as a victim of the “woke mind virus” and continues to refer to her by her former name, calling her his “son Xavier.”

St. Clair added that she has been privately making efforts to educate herself about the transgender community and to advocate for those she felt she had previously harmed.

“I don’t really know how to make amends for many of these things, but I have been trying incredibly hard privately,” she wrote. “Even this reply will become right-wing hysteria, but yeah, I am sorry. Let me know how I can help.”

She did not mention anything about transitioning a child in her public remarks.

Musk, known for his outspoken anti-trans views, replied by stating he plans to pursue full custody, though it is not clear if any official legal filings have been made.

Why Elon Musk and Ashley St. Clair Are in a Public Dispute

In February 2025, St. Clair confirmed that Musk is the father of her son, Romulus, bringing his total number of children to 13. He has six children with his ex-wife Justine Musk, three with musician Grimes, and four with tech executive Shivon Zillis.

“Five months ago, I welcomed a new baby into the world. Elon Musk is the father,” St. Clair wrote at the time. “I have not previously disclosed this to protect our child’s privacy and safety.”

Musk later publicly cast doubt on the claim.

“I don’t know if the child is mine or not, but am not against finding out. No court order is needed,” he wrote on X. He also claimed he had given St. Clair $2.5 million and was sending her $500,000 a year.

St. Clair challenged that account, claiming Musk refused to take a paternity test and used financial support as leverage.

“Elon, we asked you to confirm paternity through a test before our child was even born. You refused,” she wrote. “You weren’t sending me money, you were sending support for your child… until you withdrew most of it.”

Tensions have continued to rise.

In recent months, St. Clair has grown more outspoken in her criticism of Musk, recently accusing X’s AI chatbot, Grok, of producing altered and inappropriate images of her without permission.

Musk has not directly responded to these allegations but has warned that anyone using Grok to create illegal content will face repercussions.

So far, neither Musk nor St. Clair has confirmed any formal custody filings beyond Musk’s social media statement. Nonetheless, these latest remarks have intensified an already tense and volatile situation
