Justice Mazahar Naqvi declared reference against him an attack on the judiciary

Justice Sayyed Mazahar Ali Akbar Naqvi has termed the reference against him in the Supreme Judicial Council (SJC) a malicious campaign against him and the consequent complaints were a direct and blatant attack on the independence of the judiciary.

Justice Naqvi is due to represented by Makhdoom Ali Khan, Khawaja Haris, Latif Khosa, Ali Zafar and Saad Hashmi in the reference.

In the application filed in the Supreme Court, Justice Mazhar Ali Akbar Naqvi requests a declaration of the actions of the Supreme Judicial Council as illegal and the notice for future action by the Supreme Judicial Council as unlawful.

Justice Mazahar Naqvi in his plea, raised several questions as ” Questions of Law”:

1. Whether the very initiation of the proceedings by the SJC and the show-cause notice are without lawful authority, of no legal effect and in violation of Article 209 of the Consitution and the Rules as well as the legal and constitutional rights of the petitioner?

2. Whether the SCN and the hearing notice fulfil the legal and constitutional requirements as laid down by the Supreme Court of Pakistan?

The SJC will meet today after 2 pm to review the complaints filed against two Supreme Court judges, Justice Sayyed Mazahar Ali Akbar Naqvi and Justice Sardar Tariq Masood.

The Supreme Judicial Council has sought the records of Justice Mazahar’s properties including complete records of two plots of Lahore Cantonment and Gulberg-III have been requested.

Justice Mazahar has been facing accusations of assets in excess of income and misuse of powers.In response, Justice Mazahar Naqvi declared the current council illegal.
