Constitutional Court Declares Monal Restaurant Demolition Illegal, Orders Fresh Review

The newly established Constitutional Court of Pakistan has declared the previous demolition of the iconic Monal Restaurant illegal, marking a significant development in the high-profile legal dispute surrounding one of Islamabad’s most recognized landmarks.

The court, headed by Justice Azhar Hassan Rizvi, ruled that the earlier decision ordering the closure and demolition of the famous restaurant did not fully comply with fundamental principles of natural justice and due process.

In its detailed judgment, the Constitutional Court stated that the matter should now be reconsidered by the lower courts strictly according to legal procedures and on its merits.

The bench criticized the way the original proceedings were conducted, observing that affected parties, including the restaurant administration and employees, were not provided adequate opportunity to present their case.

Justice Azhar Hassan Rizvi noted that every party has a fundamental right to a fair hearing, and that legal procedures must be followed before taking decisions affecting businesses, livelihoods, and public interests.

The legal dispute began after a Supreme Court ruling ordered the closure and demolition of Monal Restaurant and other establishments located in the Margalla Hills National Park. The decision was based on concerns regarding environmental protection and alleged violations related to construction and land use.

However, the demolition of Monal sparked widespread debate across Pakistan. Many citizens, tourism stakeholders, and hospitality industry representatives argued that alternative solutions, including strict environmental regulations and sustainable management plans, could have been considered instead of complete removal.

For years, Monal had remained one of Islamabad’s most popular tourist destinations, attracting local visitors, overseas Pakistanis, foreign guests, and official delegations due to its scenic location and cultural significance.

Following the Constitutional Court’s decision, legal experts said the ruling reinforces the importance of due process and fair trial rights. The case will now move forward through proper legal channels, with the final outcome to be determined after a fresh hearing.

The verdict has also renewed hopes among residents and hospitality industry stakeholders that the iconic landmark may have another opportunity for restoration and revival.
