Trump Signs New Orders to Restrict US Birthright Citizenship Despite Supreme Court Ruling

US President Donald Trump has signed two new executive orders aimed at limiting birthright citizenship in the United States. The move comes after the Supreme Court rejected his earlier attempt to restrict automatic citizenship for children born in the country.

The White House said the new orders are focused on stopping “birth tourism,” where pregnant foreign women travel to the US to give birth so their children receive American citizenship.

Trump had asked Congress to pass a law after the Supreme Court ruled against his previous order in June. Instead, he has now issued new executive orders, which set government policy but do not have the same legal authority as laws passed by Congress.

According to the administration, the new orders reinterpret the limited exceptions to birthright citizenship instead of repeating the broader restrictions that the Supreme Court ruled unconstitutional.

White House aide Stephen Miller said, “That practice of birth tourism is, as of the signing of this order, hereby banned.”

The new orders also limit citizenship rights for children born to foreign government employees in the US and children of people classified as alien enemies. They could also affect people born in US territories if Congress approves a proposed law.

Legal experts say the new orders are likely to face court challenges. Immigration and civil rights groups argue the administration is trying to bypass the Supreme Court’s ruling.

The American Civil Liberties Union (ACLU) said it believes the orders will not survive in court. Former Biden administration official Deborah Fleischaker said birthright citizenship is protected by the Constitution and cannot be changed by a president.

Women’s Refugee Commission official Zain Lakhani also criticised the orders, saying they could affect the rights of pregnant women seeking legal entry into the United States.

Speaking at the White House, Trump called the Supreme Court’s earlier decision a “very unfortunate decision.” He claimed some people were using “birth tourism” to gain US citizenship for their children and said his administration would not allow it.

The US Constitution’s 14th Amendment has long guaranteed citizenship to almost everyone born in the United States, with only a few exceptions, such as children of foreign diplomats or enemy forces. Chief Justice John Roberts recently said the amendment protects the citizenship rights of every person born in the country.
