General Elections 2024 : Appellate Tribunals to hear pleas against RO’s decision for nomination papers

For General Elections 2024, the appeal process has started from today against the returning officers’ (ROs) decision for accepted and rejected nomination papers of the candidates.

The Election Commission of Pakistan’s (ECP) appellate tribunals to decide the appeals by January 10.

Any candidate or objector will file an appeal — under Section 63 — against the decision of the returning officer rejecting or accepting a nomination paper to an appellate tribunal.

There are 24 judges for appellate tribunals, nine judges will act as tribunals in Punjab, followed by six in Sindh, five in Khyber Pakhtunkhwa and two each in Balochistan and the federal capital.

As per Election act 2017, Section 63 :

(2) An Appellate Tribunal shall summarily decide an appeal filed under sub -section (1) within such time as may be notified by the Commission and any order passed on the appeal shall be final.

(3) If the Appellate Tribunal is not able to decide the appeal within the time fixed by the Commission under sub – section (2), the appeal shall abate and decision of the Returning Officer shall be final.

Over 90% of Pakistan Tehreek-e-Insaf (PTI) candidates’ nomination papers have been rejected by returning officers’ (ROs) of respective constituencies.
