‘President can transfer any judge from one high court to another’

PML-N parliamentary leader in the Senate Irfan Siddiqui has questioned if all the judges of higher judiciary have taken oath to uphold and protect the Constitution?

Taking to X, formerly known as Twitter, Siddiqui said if the judges had taken oath to uphold and protect the Constitution then is Article 200 not a part of the Constitution of Pakistan?

Under the Article 200, president may transfer any judge from one high court to other for which the consent of the concerned judge is must. Consultation with the chief justices of Pakistan and both the relevant high courts is mandatory. Should we prefer this clear constitutional clause or any letter?

Yesterday, President Asif Ali Zardari transferred three judges from Sindh, Punjab and Balochistan to the Islamabad High Court under Article 200 of the Constitution.

Lahore High Court Judge Justice Sarfaraz Dogar, Sindh High Court Judge Justice Khadim Hussain Soomro and Justice Muhammad Asif have been transferred from the Balochistan High Court to the Islamabad High Court.

A day earlier, judges of the Islamabad High Court wrote a letter to President Asif Ali Zardari on the transfer of judges from other provinces, saying that the Chief Justice should not be brought to the Islamabad High Court from the other high court.
