Maria Malinowski Sues ATF Over Fatal Raid Killing Clinton Airport Director Bryan Malinowski

The widow of Bryan Malinowski, the executive director of the Bill and Hillary Clinton National Airport, has filed a federal lawsuit against the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Malinowski was fatally shot during an ATF raid on his home in March 2024.
The lawsuit, filed by Maria “Maer” Malinowski, accuses the ATF and 10 agents of acting recklessly and violating constitutional rights. The complaint claims that the agents did not follow proper procedure when entering the Malinowski home on March 19, 2024.
What Happened During the Raid?
According to the ATF, Malinowski fired at agents when they entered his home, hitting one. The agents fired back, and Malinowski was seriously wounded. He died a few days later in the hospital.
An affidavit revealed that the warrant was tied to claims that Malinowski had bought over 150 guns between May 2021 and February 2024, and resold many without a federal firearms dealer license. Malinowski was known as a lifelong gun collector who regularly attended gun shows to buy, sell, and trade firearms.
What the Lawsuit Says
Maria Malinowski’s lawsuit argues that her husband did not know he was under investigation and believed intruders were breaking in because agents did not properly knock or announce themselves.
“The Constitution requires reasonableness,” the lawsuit reads. “Defendants must knock, announce their presence and purpose, and wait a reasonable time before entering. The ATF failed to do this.”
She is seeking unspecified damages and a jury trial, calling the death of her husband needless and tragic.
In a public statement, Maria said:
“Today’s lawsuit seeks justice for the nightmare I’ve been living for the last 14 months.”
Ongoing Controversy
A local prosecutor previously said the shooting by the ATF agent was justified. However, the incident sparked outrage among Republican lawmakers in Arkansas, who have demanded more transparency from the ATF.
The ATF has not responded to the lawsuit, saying it does not comment on ongoing legal matters.
