Justice Mazahar Naqvi objected CJP and others in Supreme Judicial Council

Supreme Court’s Justice Mazahar Akbar Naqvi in a “preliminary reply” to the show-cause notice, cited “serious prejudice” and said CJP Isa, Justice Sardar Tariq Masood and Justice Naeem Akhtar Afghan should recuse themselves and not hear the matter.

The Supreme Judicial Council, on October 27,  issued a show-cause notice to Justice Naqvi in connection with 10 complaints lodged against him over alleged misconduct and assets beyond mea ns, and directed the judge to submit a reply within two weeks.

“In the interest of propriety, justice and fairness, Mr Chief Justice Qazi Faez Isa and Mr Justice Naeem Akhtar ought not to hear the complaints against me,” he said, adding that their participation had tainted the SJC proceedings with “bias and makes all orders passed in such proceedings as being without lawful authority and of no legal effect”, Justice Sayyed Mazahar Ali Akbar Naqvi  stated in his reply to SJC.

The judge objected that CJP Isa and Justice Afghan being the chairman and member of the inquiry commission, respectively, investigating the audio leaks case against him, cannot participate in the SJC’s proceedings against him.

In an 18-page response, which he submitted to the Supreme Judicial Council Naqvi stated that the interests of justice, the due process of law and the requirements of natural justice dictate that no further proceedings of the SJC with regard to the so-called complaints against me be presided over or participated in” by the aforementioned three judges.
